Part of the Protection of Freedoms Act 2012 that allows a private parking operator to pursue the registered keeper, if strict conditions are met.

Why it matters

If the operator doesn’t meet the conditions (including delivery deadlines and required wording), they usually can’t hold the keeper liable when the driver isn’t named.

Common mistakes

  • Assuming keeper liability always applies even when an NTK is late or incomplete.
  • Confusing ANPR/postal timelines with windscreen ticket timelines.

Details

  • For ANPR/postal PCNs (no windscreen notice): the Notice to Keeper typically must be delivered within 14 days of the event to rely on keeper liability.
  • For windscreen tickets: the NTK window is different (commonly 28–56 days after the event).
  • Specific wording and evidence requirements also apply.
